How Should I Handle Pre-Closing Structural Problems?

Question: We bought a house six weeks ago. Two days before closing, the seller drove a car through the back of the garage and into the kitchen? Who’s responsible?

Answer: The seller. When you signed the purchase agreement it was understood that the property would be delivered to you in substantially the same condition as when your offer was accepted. A car protruding through a wall and any related damage are not what you bargained for and the seller has an obligation to make repairs.

You need to have your own inspector look at the property before repairs are made to assure there is no structural damage. A second inspection should be made following all work to assure that the repairs are proper and appropriate. If permits are required by local building codes, they should be delivered to you at closing. Without proper permits, insurance coverage may be limited or questionable
